General Booking, Cancellation, Payment and other Terms

Please carefully read our General Booking, Cancellation, Payment and other Terms which apply to all courses with Miha Frlec PADI CD.

  1. Definitions
    1. Miha Frlec shall be construed to comprise "the Company", as well as all their affiliates, officers, agents, employees, workers, directors and representatives.

  2. General Booking
    1. All customers must show proof of diving certification from either PADI or equivalent scuba diving certifying organizations if taking part in any non-entry level diving activity.
    2. All customers must complete and sign the relevant Liability Release and Assumption of Risk Form and Standard Safe Diving Practices of Understanding before commencing inwater activities.
    3. The Company is not permitted to dispense any medical advice. If you are unsure of a medical matter related to diving or otherwise, please seek advice from a certified Medical Practitioner before engaging in scuba diving or similar activities.
    4. Upon signing up for any diving course, irrespective of previous experience or training, the Company requires each student to complete a Medical Questionnaire. For some courses, a signed approval from a certified Medical Practitioner is required.
    5. The maximum depth permitted on all dives is limited by the certification level of the individual diver, recreational or technical, open or closed circuit. Depth limits during training dives are defined in PADI's training standards for the selected course.
    6. A course is confirmed to run at a certain location and time only after The Company confirms it in writing to the customer. The Company is not responsible for any expenses participants might have with bookung or cancelation of accommodation. The Company reserves the right to modify and/or cancel diving arrangements for the reasons listed, but not limited to, those below:
      1. the number of customers signed up for a course,
      2. limitation of logistics or support from the corresponding dive center,
      3. weather conditions making the course at the scheduled destination not possible,
      4. other ensuing technical difficulties.
    7. Customers or students who fail to participate in a course, or course training dives, for whatever reason, shall not be reimbursed by the Company for any unused or uncompleted portion(s) of the course.

  3. Insurance
    1. Customers are strongly advised to secure appropriate diving and travel insurance, with a reputable insurance provider, and applicable to the activities they will be undertaking. Such insurance should provide comprehensive coverage of at least the following: Diving and/or Technical diving, Medical, Travel, Personal Liability and Cancellation provisions.
    2. The Company shall not accept any liability for the loss or damage or theft of dive equipment or luggage during the course or whilst on the boat or in the dive center.

  4. Customer's Obligations
    1. Where the customer is negligent or irresponsible, and causes any damage to, or loss of property and equipment belonging to the Company, the customer shall recompense the Company in full, to the current market value of any loss or damage.
    2. The customer has to be physically, emotionally and mentally prepared and fit to participate in the course(es) and/or activities they have signed up for.
    3. The Company represented by any of its Instructors, may prohibit an individual's participation on a dive(s), where they are physically, mentally or emotionally unfit to dive, demonstrate a distinct lack of respect for or handle/harm marine life, consume alcohol between dives, or fail to abide by general international safe diving standards and practices.

  5. Governing Law
    1. This contract shall be governed by, construed, and enforced in accordance with the laws of Slovenia, EU.
